1. Agreement to Terms

Welcome to MyPilot. These Terms of Service ("Terms") govern your access to and use of the MyPilot mobile application and website at mypilot.app (collectively, the "Services") operated by MyPilot Pty Ltd ("we," "our," or "us").

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you may not access or use the Services. Your use of the Services constitutes acceptance of these Terms.

2. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice by updating the date at the top of these Terms and, in some cases, provide additional notice (such as adding a statement to our website, sending you a notification, or requiring you to accept the new terms before continuing to use the Services). Your continued use of the Services after such changes confirms your acceptance of the modified Terms.

We encourage you to review these Terms periodically to stay informed of any updates. If you do not agree to the modified Terms, you must stop using the Services.

3. Eligibility and Account Requirements

3.1 Age Requirements

You must be at least 16 years old to use the Services. If you are between 16 and 18 years old, you may only use the Services with the involvement and consent of a parent or guardian. By using the Services, you represent and warrant that you meet the eligibility requirements and have the right, authority, and capacity to enter into these Terms.

3.2 Geographic Restrictions

The Services are intended for users located in countries where we are authorized to provide such services. You may not use the Services if you are located in a country where such use would violate local laws or regulations.

4. Account Registration and Security

To access certain features of our Services, you may be required to register for an account. When you register, you agree to:

  • Provide accurate, current, and complete information during registration
  • Maintain and promptly update your account information to keep it accurate and complete
  • Maintain the security and confidentiality of your account credentials
  • Accept full responsibility for all activities that occur under your account
  • Notify us immediately of any security breach or unauthorized use of your account
  • Not share your account credentials with third parties
  • Not create multiple accounts for the same individual
  • Not use another person's account without permission

We reserve the right to suspend or terminate any account at our sole discretion, without notice, for any reason, including if we believe you have violated these Terms or engaged in fraudulent, abusive, or illegal activity.

5. Subscription Services and Payments

5.1 Free Trial and Basic Services

We may offer a free trial period for our premium Services or provide certain basic features at no cost. At the end of any trial period, your account will automatically be charged for the applicable subscription unless you cancel before the trial ends. Free services may be subject to usage limitations and may include advertisements.

5.2 Subscription Plans

We offer various subscription plans with different features and pricing. All subscription fees are clearly displayed before purchase and are payable in advance. Subscription fees are non-refundable except as expressly provided in these Terms or when required by applicable law.

5.3 Payment Processing

Payments are processed through third-party payment processors, including app stores (Apple App Store, Google Play) and direct payment services. By providing payment information, you:

  • Authorize us to charge the applicable fees to your chosen payment method
  • Represent that you are authorized to use the payment method
  • Agree to pay all applicable fees, taxes, and charges
  • Agree to the payment processor's terms of service

5.4 Auto-Renewal

Subscriptions automatically renew at the end of each billing period (monthly or annually) until canceled. You will be charged the then-current subscription fee unless you cancel your subscription before the renewal date. You may cancel your subscription at any time through:

  • Your account settings within the app
  • The App Store or Google Play (for mobile subscriptions)
  • Contacting our customer support team

Cancellation will be effective at the end of your current billing period, and you will retain access to premium features until that time.

5.5 Price Changes

We may change our subscription prices at any time. For existing subscribers, price increases will take effect at the start of your next billing period after we provide at least 30 days' advance notice. You will have the opportunity to accept the new price or cancel your subscription before the increase takes effect.

5.6 Taxes

You are responsible for all applicable taxes, duties, and assessments imposed by governmental authorities, except for taxes based on our net income. If we are required to collect or pay taxes on your behalf, you will be charged accordingly.

6. Refund Policy

6.1 General Refund Policy

All purchases are generally final and non-refundable, except as outlined below or as required by applicable law. We provide this refund policy to ensure customer satisfaction while protecting against abuse.

6.2 Subscription Refunds

App Store Purchases: Refunds for subscriptions purchased through the Apple App Store or Google Play are subject to the respective platform's refund policies. Please contact Apple or Google directly for refund requests.

Direct Purchases: For subscriptions purchased directly through our website or app:

  • 7-Day Satisfaction Guarantee: If you are not satisfied with your subscription within the first 7 days of purchase, you may request a full refund by contacting our support team at info@mypilot.app
  • Technical Issues: If you experience significant technical problems that prevent you from using the service, and we cannot resolve the issue within 14 days, you may be eligible for a prorated refund
  • Billing Errors: If you are charged incorrectly due to a system error, we will provide a full refund of the incorrect charge

6.3 Refund Exceptions

Refunds will not be provided in the following circumstances:

  • You have used the service extensively (beyond reasonable trial usage)
  • Your account has been terminated for violation of these Terms
  • You have already received a refund for the same subscription period
  • The refund request is made more than 30 days after the original purchase
  • You are requesting a refund due to changed personal circumstances unrelated to the service

6.4 Refund Process

To request a refund:

  1. Contact our customer support team at info@mypilot.app within the applicable refund period
  2. Provide your account information and reason for the refund request
  3. We will review your request within 5-7 business days
  4. If approved, refunds will be processed to your original payment method within 10-14 business days
  5. You will receive email confirmation once the refund is processed

6.5 Partial Refunds

In certain circumstances, we may offer partial refunds on a case-by-case basis, such as:

  • Service outages that significantly impact your usage
  • Feature changes that substantially alter the service you purchased
  • Prorated refunds for remaining subscription periods in exceptional cases

6.6 Chargebacks and Disputes

If you initiate a chargeback or dispute with your payment provider without first contacting us, we reserve the right to immediately suspend or terminate your account. We encourage you to contact our support team first to resolve any billing issues.

7. License to Use Services

7.1 Limited License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your personal, non-commercial use. This license does not include any right to:

  • Resell, redistribute, or commercialize the Services
  • Modify, adapt, or create derivative works based on the Services
  • Reverse engineer, decompile, or disassemble the Services
  • Use the Services for any unlawful purpose
  • Access the Services through unauthorized means

7.2 License Restrictions

You may not use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services.

8. User Content and Conduct

8.1 User-Generated Content

You may be able to submit, upload, or share content through the Services, including reviews, comments, feedback, and personal information ("User Content"). You retain ownership of your User Content, but by submitting it, you grant us a worldwide, royalty-free, non-exclusive license to use, reproduce, modify, adapt, publish, and display such content in connection with the Services.

8.2 Content Standards

You agree that all User Content you submit will:

  • Be accurate and not misleading
  • Not violate any third-party rights
  • Not contain illegal, harmful, threatening, abusive, or defamatory content
  • Not contain spam, commercial solicitations, or promotional content
  • Not contain viruses, malware, or other harmful code
  • Comply with all applicable laws and regulations

8.3 Content Moderation

We reserve the right to review, moderate, and remove any User Content that violates these Terms or is otherwise objectionable, in our sole discretion. We are not obligated to monitor User Content but may do so at our discretion.

9. Intellectual Property Rights

9.1 Our Intellectual Property

The Services and all content, features, and functionality thereof, including but not limited to all information, software, text, displays, images, video, audio, design, presentation, selection, and arrangement, are owned by us, our licensors, or other providers of such material and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

9.2 Trademarks

"MyPilot," our logos, and any other product or service names, logos, or slogans that may appear on the Services are trademarks of MyPilot Pty Ltd and may not be copied, imitated, or used without our prior written permission.

9.3 Third-Party Content

The Services may include content provided by third parties, including weather data, flight information, and other materials. Such content is the property of its respective owners and is protected by applicable intellectual property laws.

9.4 Copyright Infringement

We respect intellectual property rights and expect our users to do the same. If you believe that content on our Services infringes your copyright, please contact us at info@mypilot.app with the following information:

  • A description of the copyrighted work you claim has been infringed
  • A description of where the infringing material is located on our Services
  • Your contact information
  • A statement that you have a good faith belief that the use is not authorized
  • A statement that the information is accurate and you are authorized to act on behalf of the copyright owner
  • Your physical or electronic signature

10. Prohibited Conduct

You agree not to engage in any of the following prohibited activities:

  • Use the Services in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services
  • Attempt to circumvent any content filtering techniques or security measures we employ
  • Attempt to access or use another user's account without authorization
  • Introduce any viruses, trojan horses, worms, logic bombs, or other harmful material
  • Use the Services for any illegal or unauthorized purpose
  • Modify, adapt, or hack the Services or modify another website to falsely imply that it is associated with the Services
  • Decompile, reverse engineer, or otherwise attempt to obtain the source code of the Services
  • Create accounts using automated means or under false pretenses
  • Collect or harvest any personally identifiable information from the Services
  • Use the Services to transmit spam, chain letters, or other unsolicited communications
  • Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
  • Engage in any activity that could damage our reputation or the reputation of the Services

11. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy.

12. Third-Party Services and Links

The Services may contain links to third-party websites, applications, or services that are not owned or controlled by us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible or liable for any damage or loss caused by your use of any such third-party services.

13. Disclaimers and Warranties

13.1 General Disclaimers

THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. WE EXPRESSLY DISCLAIM ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

13.2 Service Availability

WE MAKE NO WARRANTY THAT:

  • THE SERVICES WILL MEET YOUR REQUIREMENTS OR EXPECTATIONS
  • THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE
  • THE RESULTS THAT MAY BE OBTAINED FROM THE USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE
  • THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS
  • ANY ERRORS IN THE SERVICES WILL BE CORRECTED

13.3 Content Accuracy

We do not warrant the accuracy, completeness, or reliability of any content or information provided through the Services. Any reliance you place on such content is strictly at your own risk.

14. Aviation and Safety Disclaimer

THE MYPILOT APP IS DESIGNED AS A SUPPORTIVE TOOL FOR PASSENGERS WITH FLIGHT ANXIETY AND SHOULD NOT BE USED FOR AVIATION NAVIGATION, PROFESSIONAL METEOROLOGICAL PURPOSES, OR ANY SAFETY-CRITICAL APPLICATIONS. OUR TURBULENCE FORECASTS AND TRACKING ARE INFORMATIONAL ONLY AND SHOULD NOT REPLACE OFFICIAL AVIATION WEATHER INFORMATION OR PILOT INSTRUCTIONS.

PLEASE FOLLOW ALL FLIGHT CREW INSTRUCTIONS AND SAFETY PROCEDURES REGARDLESS OF ANY INFORMATION PROVIDED BY OUR APP. WE ARE NOT RESPONSIBLE FOR ANY DECISIONS MADE BASED ON OUR APP'S DATA. THE SERVICES ARE NOT INTENDED TO REPLACE PROFESSIONAL MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT FOR ANXIETY OR OTHER MEDICAL CONDITIONS.

15. Limitation of Liability

15.1 General Limitations

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WE, OUR AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, THAT RESULT FROM THE USE OF, OR INABILITY TO USE, THE SERVICES.

15.2 Damage Limitations

IN NO EVENT WILL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION (WHETHER IN CONTRACT, TORT, OR OTHERWISE) EXCEED THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE INCIDENT GIVING RISE TO LIABILITY, OR, IF GREATER, ONE HUNDRED DOLLARS ($100).

15.3 Jurisdictional Variations

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS, OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

16. Indemnification

You agree to defend, indemnify, and hold us, our affiliates, officers, directors, employees, agents, and licensors harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with:

  • Your access to or use of the Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any User Content you submit or share through the Services
  • Your willful misconduct or negligent acts

17. Termination

17.1 Termination by You

You may terminate your account at any time by contacting our customer support team or through your account settings. Upon termination, your access to the Services will cease, but these Terms will continue to apply to your prior use of the Services.

17.2 Termination by Us

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you:

  • Breach these Terms
  • Engage in fraudulent, abusive, or illegal activity
  • Violate the rights of others
  • Provide false or misleading information
  • Fail to pay applicable fees

17.3 Effects of Termination

Upon termination, your right to use the Services will immediately cease. We may, in our sole discretion, delete your account and all associated data. Sections of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

18. Force Majeure

We shall not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including but not limited to acts of God, natural disasters, terrorism, riots, or war, actions of governmental authorities, or other force majeure events.

19. Governing Law and Jurisdiction

These Terms and your access to and use of the Services shall be governed by and construed in accordance with the laws of New South Wales, Australia, without giving effect to any choice or conflict of law provision or rule. Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of New South Wales, Australia, and you hereby consent to the personal jurisdiction and venue therein.

20. Dispute Resolution

20.1 Informal Resolution

Before initiating any formal dispute resolution process, you agree to first contact us at info@mypilot.app to attempt to resolve the dispute informally. We will work in good faith to resolve any concerns you may have.

20.2 Arbitration

If we cannot resolve a dispute through informal means, any dispute arising from or relating to the subject matter of these Terms shall be finally settled by binding arbitration in Sydney, Australia, under the Commercial Arbitration Rules of the Australian Centre for International Commercial Arbitration (ACICA). The arbitration will be conducted in English, and the arbitrator's decision will be final and binding.

20.3 Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

21. Miscellaneous

21.1 Entire Agreement

These Terms, together with our Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and us regarding the use of the Services and supersede all prior agreements and understandings.

21.2 Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, such provision shall be struck from these Terms, and the remaining provisions shall remain in full force and effect.

21.3 Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by us.

21.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted assignment in violation of this section is void.

21.5 Headings

The headings in these Terms are for convenience only and have no legal or contractual effect.

21.6 Language

These Terms are written in English. Any translation is provided for convenience only, and the English version will prevail in case of any conflict.

23. Effective Date

These Terms are effective as of the date last updated above and will remain in effect until modified or terminated in accordance with the terms herein.
